What TCEQ permits are required for power plants in Texas?

Permitting scope depends entirely on technology. Solar and batteries burn nothing, so they need no air permit. Gas turbines and engines are combustion sources, and the permit lift scales with size and run profile. Here is the full stack, technology by technology.

1Air permits for gas-fired generation

TCEQ's authorization tiers for turbines and engines, from lightest to heaviest:

Permit by Rule 106.511 (emergency and standby units)

PBR 106.511 ↗ covers engines and turbines used only for emergency or standby service — no registration, no fee. Fine for black-start and backup units; not available for anything selling power or running on dispatch.

EGU Standard Permits

The Air Quality Standard Permit for Electric Generating Units ↗ (30 TAC §§116.601–615) and the newer Natural Gas EGU Standard Permit provide pre-set conditions for qualifying gas-fired units — the fast lane for peakers, reciprocating engine plants, and distributed generation that meets the emission and operational limits. Registration and protectiveness review, but no case-by-case BACT fight.

Case-by-case NSR with PSD review (combined cycle and large simple cycle)

Utility-scale plants — combined cycle blocks, large simple cycle installations, multi-turbine campuses — require a case-by-case NSR permit under 30 TAC Chapter 116, and fossil fuel-fired steam electric plants over 250 MMBtu/hr sit on the federal listed-source categories, making PSD review at the 100 tpy major source threshold routine. Expect:

  • BACT: dry low-NOx combustors + SCR for NOx, oxidation catalyst for CO — TCEQ publishes BACT levels for every permitted turbine project of 20 MW+ on its turbine project list ↗
  • CEMS for NOx and CO with compliance assurance monitoring
  • GHG PSD permitting — TCEQ handles greenhouse gas PSD review for major projects
  • Air dispersion modeling, public notice, and — for plants near neighbors — contested case hearing risk
  • Timeline: 12–24 months, and the permit must issue before construction

Key point on timing: a case-by-case NSR permit with PSD review must issue before construction begins and typically runs 12–24 months. On utility-scale gas projects it belongs on the critical path from day one — though ERCOT queue timing often exceeds it.

2Title V Federal Operating Permit

Combined cycle and large peaker sites exceed the 100 tpy major source threshold and need a site-specific Title V operating permit, filed within 12 months of startup. Title V consolidates NSR conditions, NSPS (Subpart KKKK for new combustion turbines, TTTT for GHG), and Chapter 117 requirements into one permit with semiannual deviation reporting. Smaller standard-permit peakers often stay minor and avoid Title V entirely.

3Chapter 117 NOx rules for utility generation

Texas layers regional NOx control on top of NSR permits under 30 TAC Chapter 117 ↗, part of the ozone SIP: system-wide NOx caps and unit limits for utility electric generation in East and Central Texas, with the tightest requirements in the DFW and Houston-Galveston-Brazoria ozone nonattainment areas. New units entering these regions inherit cap-and-trade style allocations and CEMS obligations — a real siting consideration when comparing a DFW site against a West Texas one.

4Cooling water: the steam-cycle permit layer

Simple cycle peakers, engines, solar, and batteries skip this entirely. Combined cycle and steam plants don't:

  • TPDES individual permit for cooling tower blowdown and thermal discharge, with effluent temperature limits
  • CWA §316(b) intake structure requirements for plants drawing surface water — impingement and entrainment controls
  • Water rights: surface water diversion for cooling requires a TCEQ water right or contract from an existing holder
  • The West Texas workaround: air-cooled condensers and dry cooling eliminate most of this layer, which is one reason data center-adjacent gas plants cluster in arid basins

5Stormwater — every technology

  • Construction GP (TXR150000) ↗: required for 1+ acre of disturbance — which covers every utility-scale project, and solar farms disturb thousands of acres. SWPPP, NOI for 5+ acres, NOT at stabilization.
  • Multi-Sector General Permit (TXR050000), Sector O: operating steam electric plants need industrial stormwater coverage; solar and standalone batteries generally do not once construction ends.

6Non-TCEQ approvals that gate the project

Not TCEQ, but on every developer's critical path: ERCOT generation interconnection (queue position, studies, and — for co-located load — net-metering review under 16 TAC §25.205), PUCT registration, Texas Energy Fund loan milestones for dispatchable projects, county tax abatement agreements, and FAA determinations for stacks and met towers. SPCC plans apply wherever oil-filled transformers and fuel storage exceed federal thresholds.

Do solar farms and battery storage need TCEQ air permits?+

No. Solar PV and battery energy storage systems have no combustion sources, so no air permit is required. They still need TPDES Construction General Permit (TXR150000) coverage for construction disturbing one acre or more, and county/ERCOT approvals apply.
